Welcome to Era House Furniture and Décor. Please read our terms and conditions carefully before committing to a purchase. We have made every effort to make our Terms and Conditions easy to read and understand as possible. If you have any questions, please contact us on 0434 807 081 or assist@era-house.com.au.

Your purchase of products from us constitutes your agreement to follow these Terms and Conditions and to be bound by them. These terms and conditions and any contract including them is governed by the law of the state in which the seller accepts the buyers order and thus both submit to the jurisdiction of the courts of that state.

ABOUT OUR TERMS AND CONDITIONS

In these Terms and Conditions “we” and “us” mean Era House Furniture and Decor – ABN: 31 214 397 465 and “you” and “your” means you the customer.

By using our website, you unreservedly accept these Terms and Conditions, including our Privacy Policy, and you agree that your use of our website, including any purchase of goods from us, is subject to the terms thereof.
These Terms and Conditions cannot be varied without our written consent. We may update these Terms and Conditions from time to time and the current version will always be shown on the Terms and Conditions page of our website. If you do not agree to these Terms and Conditions, you must not use our website in any manner.

OUR PRODUCTS

Thank you for choosing Era House Furniture and Decor product. Our pieces may be hand crafted and hand finished to provide the signature Era House look. Although our suppliers specialise in producing and reproducing quality products to certain specifications, some products may vary in measurement, texture, finish and colour. As timber is a natural product, each piece may be different and vary over time with exposure to light and use.

Natural imperfections are normal and may include knots, grain and surface texture. Products have a standard, one year warranty on manufacturing faults. Era House Furniture and Décor is not responsible for the condition of furniture that has been used inappropriately. Claims will not be accepted outside of the 1 year warranty.

We endeavour to ensure that all the products on our website are accurately described, and we rely on information provided to us by our suppliers. Unfortunately, on some occasions it is possible that our website will contain errors and we reserve the right to correct any errors or inaccuracies at any time, including after you have placed an order. In some cases the products we offer for sale are hand-made or made from natural or organic materials, and there may be small variations between the product image(s) and the product you receive. This will always be stated on the individual product listing. We endeavour to ensure that all colours are displayed accurately, but you should be aware that colours may appear slightly differently on different displays and screens. The shade of colour from screen to screen is not a fault or error. This will be classified as a change of mind and returning items based on change of mind will be at the expense of the customer.

FINISHES

Our furniture pieces are hand crafted and hand finished to provide the unique Era House look and may vary in measurement and finishing colour. Although our suppliers endeavor to reproduce consistently, we do not consider minor measurement differences or slight colour variations flaws. As timber is a natural product, each piece may be different and vary over time with exposure to light and use. Natural imperfections are normal and may include knots, grain and surface texture and distressed highlights in different areas. Due to the handmade nature of our items, we celebrate subtle variations from product to product.

Colours and finishes as shown on our website photographs are displayed differently on every monitor and computer system. As such, colours and finishes displayed should be considered a guide rather than an accurate representation of the actual finish. We therefor suggest that you obtain a colour sample from us via post in order to get the closest colour representation as possible. There are 2500 colours available. Should you want to choose a colour that is not displayed on our website, please provide us with a colour sample so that we can match it as close as we possibly can to one of the colours in our extended colour palette. Colours need to be signed off upon placing your or your clients order. Era House Furniture and Décor reserve the right to charge for providing colour samples at any time.

We will not offer a refund due to a variation in colour from that depicted on our website and your screen.

UPHOLSTERY

Our upholstery colours may vary due to different dye lots. Please contact us to request a sample of the current stock. Customers may also supply their own fabric. Please check the fabric for any faults before sending it to us for upholstery. Customers own fabric received will be deemed suitable for immediate upholstery.

If you have specific upholstery requirements, please express these requirements in writing. A surcharge may apply for specific upholstery requirements. Specific upholstery needs need to be signed off by you, the client or your representative.

OUR WEBSITE

To the extent permitted by applicable law, we do not warrant that the product descriptions, colours, information or other content available or offered on our website are accurate, complete, reliable, current or error-free, nor do we make any warranty about the standard or quality of any of the products offered via our website.

On rare occasions our suppliers find themselves unable to deliver products to us, or the products delivered are not of sufficient quality or workmanship. We reserve the right to withdraw any products from our website at any time and/or remove or edit any materials or content on our website. Whilst we will make our best efforts to process all orders, there may be exceptional circumstances which mean that we may need to refuse to process an order after we have sent you an order confirmation, which we reserve the right to do at any time, at our sole discretion. We will not be liable to you or any other third party by reason of our withdrawing any product from our website, whether it has been sold or not, removing or editing any materials or contents on our website, or for refusing to process or accept an order after we have sent you the order confirmation.

We aim to update our website regularly, and may change content at any time. If the need arises, we may suspend access to our website, or close it indefinitely. We will use reasonable endeavours to ensure our website contains accurate information and content, however, we reserve the right to update our website as soon as an inaccuracy or error is brought to our attention. 

ORDERS

ELECTRONIC ORDERS – VIA INTERNET OR E-MAIL

(For goods ordered unseen)
Online orders are to be paid by credit card or bank deposit. Your written purchase request is a confirmation of your order and bound by our terms and conditions. Goods ordered uninspected by the client either online or via e-mail are also bound to our change of mind policy. Each computer displays images slightly differently and as Era House Furniture and Décor’s items are handmade, each may have slight variations in finish and construction.

TRADE ORDERS

For design professionals, we can offer trade arrangements when supplied with appropriate business registration information. Ordering must be in writing from the designer or contractor. Payment is the responsibility of the designer or contractor and it is the responsibility of the designer or contractor to advise their client of the suitability (size, finish etc.) of the product for their clients’ individual requirements.

CUSTOM ORDERS

Custom orders include the following attributes as specified by the client or the client’s representatives/Designer/Contractor:

  • Large quantity orders
  • Specific sizes manufactured or ordered to bespoke specifications
  • Specific styles manufactured or ordered to bespoke specifications
  • Specific finishes that are not listed as standard on our website at the time of order
  • Specific colour (s) or matched colour that are not listed as standard on our website at the time
  • Upholstery of products in any fabric supplied or chosen by the customer/customer’s representative/designer/contractor

If products are made to customer specifications and issues arise due to customer design and specifications, Era House Furniture and Décor takes no responsibility to repair or replace the product. In the event that Era House Furniture agrees to arrange repairs on bespoke products, Era House Furniture and Décor will charge for this additional work.

FLOOR STOCK OR EX-DISPLAY PRODUCT

All floor-stock or ex-display items are purchased in “as is” condition. Some of these items may warrant a discount; these items are non-refundable and sold in an “as in” condition. It is the responsibility of the customer to inspect their items prior to purchase. Any damage incurred from the transportation and/or in-home use of floor-stock/ ex-display items is not the responsibility of Era House Furniture and Décor. The sale of these items is at the discretion of Era House Furniture and Décor Management.
No additional discounts or reductions will apply, not in conjunction with any other offer. Additional discount on these items for trade or wholesale customers may not always be available and will be given at the discretion of Era House Furniture and Decor Management.

PLACING ORDERS

You may place your order either by phone, e-mail or by adding items to your shopping cart on this website. Order confirmation will be sent via e-mail.

By placing an order, you make an offer to us to purchase the products you have selected based on these Terms and Conditions.

If we cannot process or accept your order after payment is received due to unforeseen circumstances, we will contact you personally by email or telephone to arrange a refund, or a revised delivery time.

When a deposit has been paid, a contract has been entered into and the Era House Furniture and Decor may be entitled to retain all or part of your deposit. This can vary, depending on time spent on the transaction and work involved, so as to compensate the Era House Furniture and Decor for this time.

Orders for goods that are in stock must be paid for and collected / delivered within two weeks. If the goods have not been paid for and collected within this time frame, a courtesy call will be made. Goods not collected or delivered within this period may incur a storage fee determined by, and at the discretion of Era House Furniture and Decor, of the total value of the order.

Era House Furniture and Decor reserves the right to cancel an order, retain the deposit received and resell the items. All goods remain the property of Era House Furniture and Decor until paid for in full. Arrival/ shipping times are quoted in good faith, but we are not responsible for unforeseen delays in manufacturing and shipping and we will endeavour to advise when such delays occur.

PAYMENT OPTIONS

Payment of your purchases can be made as follows:
All major credit and debit cards (except but not limited to American Express and Diners Club) or Direct Deposit-EFT

Internet Banking – Please ensure your Order Number is included as the Reference Number within your payment details area. This will assist us in identifying your order and processing it quickly. You can deposit the money directly into our bank account via electronic funds transfer. Bank details will be supplied once you have confirmed your order in writing.?

PAYMENT SECURITY

Your privacy and the security of your information are paramount to us. All our online payments are processed using a secure e-commerce payment gateway.

If making a payment by credit card over the phone your credit card details will be taken by an authorised staff member. Once the payment has been processed and authorised your credit card details will be destroyed.

DELIVERIES

Era House Furniture and Décor’s personalised, 3rd party service ensures that your furniture purchase arrives at your door as economically as possible and in the hands of specialists. Upon receiving your order, we will be in contact with an expected delivery date into our warehouse and will commence delivery arrangements in consultation with you. Please expect a delivery time once the item is received into our warehouse of up to 2 weeks (longer for outer country areas or in peak periods) depending on where you are and the direction our drivers are heading.

As the 3rd party drivers are specialists, we would ask for your patience if delivery takes an extra week or two – you can be assured of your purchase being delivered in trusted hands. Please note that standard furniture delivery has 1 man on the truck, therefore he will require help to lift the item off at point of delivery. If no-one is able to assist an additional fee may apply to cover a further resource.

Delivery quoted is for the item to be delivered inside the front door for properties with easy access. If you require the item to be transported to the room of your choice or you have difficult access, please contact us for a quotation and we will be pleased to assist.

At all times we do our best to work around your time frame. Your satisfaction is our highest priority, so please do not hesitate to contact us if you have any questions about your delivery or furniture availability.

DIRECT DELIVERY FROM THE FACTORY TO A CUSTOMER’S NOMINATED RESIDENTIAL ADDRESS (NOT LIMITED TO AND IN ADDITION TO OTHER STANDARD TERMS)

• Era House Furniture and the shipping companies that they use, are not common carriers. All business transacted is subject to each business’ standard
terms and conditions.
• Trucking is based on Metro Area, with collection based on Shipper/Consignee un/loading truck. Trucking companies allow ½ hour waiting time at Site and
½ hour at Un/Packing Depot, delays after this period are charged to Shipper/Consignee account and charged at a minimum of AUD 65.00 per hour or part
thereof to Era House, who in turn will pass the final amount onto their customer. In addition, our drivers are not permitted to assist in the loading
or unloading of containers
• Delivery quoted as standard all-day service. It assumes that a forklift and labour will be available to unload at drop-off point. Please note: Over 50
kg cargo per piece, our local pickup and delivery quotation is based on the sender/receiver having appropriate cargo handling equipment and truck
access on road level for unload/load purposes.
• Freight insurance for direct to client delivery service, only covers shipping up and till the point at which the truck stops at the delivery address.
Insurance does not cover accidents or damages that occur during handling and unloading of the goods by the customer, their assistant(s) or
subcontractors.
• Era House Furniture and Décor will not be liable for any injury or damages that occur during or after delivery or installation by the customer, their
assistant(s) or subcontractors.
• All bookings are subject to carrier acceptance and space availability. Transit times / cut off days & times may vary.
• Rates are not applicable to Dangerous Goods, perishable or over-dimensional cargo unless specifically detailed in a quote.
• Additional Costs could be charged as inspection, quarantine physical inspection, etc. and may be passed on to the customer – even if no other delivery
fees applied before.
• As rates are based on information supplied by customers, we reserve the right to adjust the quoted price should the conditions change.
• Era House and their chosen shippers strongly support “Chain of Responsibility” legislation to stamp out illegal operating procedures in the industry.
Both parties feel that our customers, employees or our business units should not be put in the situation where they are exposed to prosecution for
operating illegally within the supply chain.
• All other rates and services needed to complete this task may be charged to the customer per the prevailing standard rate schedule at the time of the
service being provided.
• Pricing is based on the current shipper’s nomination of carriers. Due to the volatility of Import airfreight & sea freight rates, they will be held
for a minimum period of 7 days from date of the quotation.
• E&OE (Errors and Omissions Excepted.)
• Sea freight Less than Container Load (LCL): Minimum = 1 CBM Ratio: 1 CBM = 1000kgs. o Freight charges are calculated on whichever the greater on
ratio.
• Sea freight Consolidation Rates (LCL) are quoted on the basis that cargo can be loaded in a Standard 20 ft General Purpose Container with maximum
measurements: These rates do not apply to HAZARDOUS, OVER DIMENSIONAL and PERISHABLE cargo. o Length 5.9 metres (19.5 ft) Width 2.23 metres ( 7.8 ft)
Height 2.23 metres ( 7.8 ft)
• Sea freight CAF/BAF – Currency and Bunker Adjustment Factor is levied by the shipping lines and is subject to fluctuation without notice. Any increase
in currency exchange rate at time of payment, may be passed on to the end customer.
• Check your delivery as soon as it arrives. If you are signing for a receipt by the Courier, inspect the carton first and if it looks like it is
damaged, make a note of this on the Couriers copy of the receipt. Failure to do so may negate your ability to make a claim. If you deem the item as
faulty you must also attach photographs of your complaint for approval of return. Damages must be reported within 24 business hours of receipt
otherwise no claim will be accepted. Therefore, we highly recommend that you inspect your goods immediately upon arrival.

DELIVERY CHARGES

The client is responsible for all freight and handling charges for goods being sent. Era House Furniture and Decor uses third party carriers/delivery drivers. Era House Furniture and Decor takes no responsibility for the actions of third party carriers/delivery drivers.

TRANSIT INSURANCE

Although third party carriers/delivery drivers take all due care with your valuable items, we highly recommend that you take out transit insurance as Era House Furniture and Decor takes no responsibility for damage caused to private or public property during transit or delivery and cannot be held liable for any indirect, special or consequential loss or damage arising in any way in relation to delivery.

Insurance for goods in transit is not included in the purchase price. If you do choose transit insurance, you must thoroughly check your delivery for damage caused in transit before signing for it, otherwise if the item is signed for and transit damage is evident, insurance is voided. Era House Furniture and Decor is not liable for any damage or discrepancies after the package has been accepted on delivery. Notification of faulty or damaged goods must be advised within 24 hours upon receipt of item by phone 0434 807 081 or email us at assist@era-house.com.au

SIZE CONSTRAINTS

It is the customer or their representative’s responsibility to check that ordered items will fit into the required space. Era House Furniture and Decor takes no responsibility for products that do not fit due to space constraints for example doorways, hallways, around corners, lifts etc. Era House Furniture and Decor will not accept returns due to these issues. Extra costs may be incurred where furniture need to be carried upstairs or where deliveries are made difficult due to site access, narrow or obstructed spaces. Please advise Era House Furniture and Décor of any possible delivery issues prior to requesting a delivery quote. Special requests upon or during delivery will not be accepted.

INSTALLATION OR ASSEMBLY OF PRODUCTS

Due to OH & S, Era House Furniture and Décor and third party delivery carriers/delivery drivers do not and are not responsible for moving goods that are not Era House Furniture and Decor products. ?Era House Furniture and Décor reserves the right to refuse delivery due to issues or concerns of access. The purchaser is responsible for protection of flooring, carpet, rugs etc. prior to delivery.

Please let us know if you would like for the furniture to be assembled upon delivery. We will then arrange this on your behalf with the third party carrier/delivery person. Any assembly or installation is subject to surcharge. The assembly or delivery costs will be calculated per item and needs to be signed off by the customer or their representative. No other work, other than what was specified and paid for by the customer, will be carried out on the day of delivery. It is the customer’s responsibility to ensure that any obstructions are removed prior to delivery or installation. Please ensure that your carpets are protected and that there are no trip hazards that can cause harm or injury to persons present during delivery including third party carriers/delivery persons.

DELIVERY DATES

Items in stock will be available for delivery when the carrier is arranged. Items manufactured are made to order and delivery takes between 12-16 weeks. All delivery dates are approximates only. Era House Furniture and Decor will use its best endeavours to deliver all goods in a timely manner.  We will update you during the production period if any delays are expected.

DELIVERY ADDRESS ??Please provide us with a delivery address where deliveries can be made during normal business hours from Monday and Friday. A Post Office box address cannot be accepted.

FAILED DELIVERY

If there is nobody to sign for the goods when they are delivered the freight carrier will leave a missed delivery advice card in your letter box advising of the failed delivery. The goods will then be returned to their local depot or in some cases, our warehouse and you will then need to make contact with the freight carrier directly to arrange an appropriate time for a re-delivery. A second delivery fee may incur.

DELIVERY INSTRUCTIONS

Please provide clear delivery instructions within the “Special Delivery Instructions” area of the checkout. Many of the products on our website are large and heavy in nature and may require special delivery arrangements. It is imperative that you provide us with any special delivery details relating to your delivery address. Should your delivery address be in an apartment block, high rise building, block of units or flats or have restricted access you must notify us, so that special arrangements can be made if necessary.

DELIVERY TIMES

If your order contains multiple products then individual products may be delivered on different days, depending on the availability of freight carriers on any given day to facilitate the delivery. In most cases we expect delivery to be completed within 10-14 work days after goods have come into stock, depending on where you live. However please note that on occasion delivery times may change based on factors outside of our control such as supply interruptions or your delivery location.

To ensure that your items are delivered safely to your delivery address, please ensure that you or your representative is available to take receipt as well as sign for goods upon delivery. Your contact details and phone numbers may be passed onto our logistic companies and they are requested to contact you in advance to advise of the anticipated date and approximate time of delivery.

COLLECTIONS

When collecting, the purchaser is responsible for checking the condition of goods prior to leaving the premises – the care and responsibility is then with the purchaser. Any damage claims will not be accepted after collection.

REFUNDS AND RETURNS

Customer satisfaction is paramount to us. To make sure that our customers love the Era House experience, we ensure that our Terms and Conditions are in line with that of NSW Governments Department of Fair Trading. Our refund policy is fully compliant with Australian Consumer Law. Our commitment is to ensure you are happy with our service and our product, so in special cases we may make exceptions in your favour.

By consumer law, you may be entitled to a refund or repair or exchange or a credit if the products you have bought are:

  • Faulty
  • Significantly different to those shown or described to you
  • Not doing what they are supposed to do
  • We do not refund for change of mind.

METHOD OF PAYMENT OF REFUNDS

You accept that all refunds will be provided to you by electronic funds transfer to your nominated account or in any other way decided at the discretion of Era House Furniture and Decor.

RETURNING FAULTY PRODUCTS

Check your delivery as soon as it arrives. If you are signing for a receipt by the Courier, inspect the carton first and if it looks like it is damaged, make a note of this on the Couriers copy of the receipt. Failure to do so may negate your ability to make a claim. If you deem the item as faulty you must also attach photographs of your complaint for approval of return. Approved returns must be sent to our Warehouse. Damages must be reported within 24 business hours of receipt otherwise no claim will be accepted. Therefore, we highly recommend that you inspect your goods immediately upon arrival.

Trade customers must inspect goods before forwarding to their customer.

Products taken by the customer or the customer’s representative are taken at the customer’s risk. We do not provide warranty for products damaged in transit by the customer. The customer is advised to inspect the goods before taking them.

If there is a problem with the product other than being damaged transit, let us know in writing within 24 hours of receiving the goods. You may be entitled to a full refund, replacement, repair or compensation. Proof of purchase will be required. We check all items before shipping but if you should receive an item that is faulty or damaged, we will offer a full refund or replacement item. Please contact us to discuss.

We reserve the right to request that faulty items be returned for inspection before issuing a refund or replacement.

Return shipping is at the buyer’s expense and will be refunded at the discretion of Era House Furniture and Décor upon inspecting returned goods.

Please ship in protective packaging as goods damaged in return shipping will not be refunded.
Once we have confirmed the fault, we will refund both the cost of the item and the shipping costs or provide a replacement item.

Any item that is returned used or has been damaged after receipt by the customer will not be accepted for refund. Damages caused by the customer during transport to and from their own home or delivery location, Era House Furniture and Decor take no responsibility for.

PRODUCTS DAMAGED IN TRANSIT

Era House Furniture and Decor do not carry transit insurance. Transit insurance must be obtained by the customer before delivery is arranged. Where you have signed for goods without outlining any faults or damage then these goods may not be covered by your transit insurance. You must inspect your goods upon delivery and outline any faults or damage on the delivery note before signing it. We recommend that you ask the driver to initial your remarks. If possible, please take a photo of the damage immediately following the delivery.

You must notify Era House Furniture and Decor of any faulty or damaged goods within 24 hours of receipt of the goods. Failures to do so will that we may not be able to assist you with your insurance claim.

MANUFACTURERS FAULT OR FLAW

Should you detect a manufacturers fault with your item you must notify us in writing within 7 days and include photos. You will be offered a replacement item or a refund.  Faults not reported within 7 days are not eligible for a refund or replacement.

We reserve the right to request that faulty items be returned or collected and inspected before issuing a full refund or replacement.  Ownership of faulty goods are reverted back to Era House Furniture before refunds are issued.

 

INCORRECT DELIVERY

Please contact Era House Furniture and Decor within 24 hours of the delivery of an incorrect item. We will arrange for the collection of the incorrect item and delivery of the correct item. You will not incur any additional costs in this circumstance. Your replacement item will be delivered to you within the normal delivery time frame for that item.

GOODS DAMAGED BY YOU AND NATURAL WEAR AND TEAR

We will not accept the return of goods that are damaged by you (accidentally or otherwise) or due to natural wear and tear following delivery.

CANCELLATIONS

Cancellations must be submitted to Era House Furniture and Decor in writing by email.

If you decide to cancel your order and production of your goods have not started, we will refund you in full less any transaction costs and bank fees incurred by Era House Furniture and Décor.

If you cancel your order at any point after production has started, a cancellation fee of 50% of the total order value will apply.

Custom or special ordered goods i.e. bespoke customer design or sizes, non-standard paint finish or any upholstered items, are non-refundable if cancelled, unless the item proved to be faulty.

WARRANTY

Era House Furniture and Decor has a one-year structural warranty on all its furniture items. This warranty does not include general ‘wear and tear’ of painted, veneer surfaces or fabrics. Surface damages, fabric damage or you require some advice on how to protect your items in your home or cleaning recommendations, please contact us.

PRICING AND PAYMENTS

Pricing may change without notification. Era House Furniture and Decor has the right to withdraw an item from sale at their discretion. Era House Furniture and Decor is entitled to take action to recover the balance owing on an invoice. The client shall be responsible for any costs incurred by Era House Furniture and Decor to recover this money including legal costs, solicitor’s fees, court costs, bailiff’s fees and fees paid to debtor collector.

COPYRIGHT INFORMATION

This web site and its contents are the property of Era House Furniture and Decor Pty Ltd and are subject to copyright. The contents of our web site and the web site as a whole are intended solely for your personal, non-commercial use. Any use of our web site and its content for purposes other than personal and non-commercial use is prohibited without the prior written permission of Era House Furniture and Decor. Using any photographs of Era House Furniture and Decor without written approval will be considered as a copyright breach and must be removed immediately.

PASSING OF RISK AND TITLE

Title to and all risk associated with the products passes to you upon the products being dispatched.

PROHIBITED CONDUCT

You must not use this website for any unlawful purpose and you must not:

  • Use this website for any purpose other than for reasonable personal use in connection with the legitimate purchase of our products
  • Transmit to or via this website, any information which breaches any laws or regulations or infringes a third party’s rights
  • Use or disclose another person’s personal information, name, details, username or password without their permission
  • Interfere with, tamper with, hinder the operation of, or make unauthorised modifications to this website or its associated systems
  • Knowingly transmit any viruses or other disabling feature to the website
  • Remove any copyright, trade mark or proprietary rights notices contained in or on this website
  • Use the website otherwise than in accordance with these Terms and Conditions

INTELLECTUAL PROPERTY

Unless otherwise stated, Era House Furniture and Decor owns or has a valid licence to use all copyright and trade marks in the content of this website.

You must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, frame or embed in another website or distribute in any way any content contained on or in this website, except as expressly approved by us in writing or as permitted by law.
